Distracted Driver Hit A Runner

Hi Morning. Distressing news isn't it? This happened yesterday morning around Hartamas and I received a tweet from fellow runner @JulesMohd informing me about a man trying to run away but was caught by a few runners after he hit (with a 4wd truck) a lady runner.

The driver tried to run away by running up the slope (accident happen near the nursery under the Jalan Duta flyover, Hartamas side near Istana Negara). The driver claimed he was trying to retrieve his phone that has dropped onto the floor. By doing that, he swerve from his lane to the opposite lane. 

If there were another car/vehicle, the accident would had been major. 

It also appeared (from those that were there on Sunday) that the 4wd roadtax has expired. This meant insurance claim against the driver or vehicle owner will not be possible. 

When I read about this, It angers me. My wife was hit by a distracted motorcyclist last year October. She suffered and still recovering from the accident with the backache a constant bother nowadays due to compression of the spine at T10. 
The victim of this accident, Ms. Lai, was rushed to GH and were reported to be under went operation to remove blood clot and is warded at intensive neuro unit.

From the photo above, I know exactly where this is. Coming from Publika, this is right before the underpass/flyover and this is where the nursery (plants) were. This road is a curve (left curve) and for the driver to crash through this way, he would had been so distracted, went across the road, hit Ms. Lai and rolled her under the car.

AND HE TRIED TO RUN AWAY BY RUNNING UP THE SLOPE

Lets all pray for Ms. Lai's recovery and the driver to be charged for attempted murder.

I would also like to remind all friends, family and readers here to STOP using your handphone while driving. Those Facebook updates, Tweets and Instagrams can wait. The Whatapps messages, WeChat etc will not expire if you reply when you reach your destination. Being distracted puts you and those on the road at high risk. You may say you have been doing this and nothing happen - PLEASE DO NOT WAIT for something to happen before deciding what you did was IDIOTIC and STUPIDITY at it's highest degree.

Update August 19. 4.30pm
The Team captain for Pemaisuri runner has reported that the scan shows the blood clot in Ms. Lai's head is minimal and no surgery is needed. She is sedated and they are waiting for her to wake up.

  3. Notwithstanding the expired road tax, hence non-existence of insurance coverage, a civil action can still be initiated against the driver. If the driver is unable to pay the damages awarded by the court, then bankruptcy proceedings can be initiated. It is not about the monetary damages, but to ensure the driver is punished accordingly for his foolish action. His reason which was to retrieve a phone, is simply outrageous.

    However, civil action can be costly and time consuming, but perhaps someone can set-up a trust fund if need be to ensure the driver is dealt with accordingly (in accordance with the laws of course:) )

    2. This sounds like an open/shut case for dangerous driving. Make a police report, get a lawyer to represent her interest in pushing the Attorney General's Chambers for a charge under the relevant section under the Road Transport Act and at the end of the proceedings if he is found guilty either by way of full trial or a guilty plea, Mrs. Lai can make a Victim Impact Statement as to how this accident has affected her life and the said lawyer can make submissions as to compensation due to her owing to the said accident.

      This may go faster than the civil proceedings suggested above as it is likely the preponderance of the eye witness evidence would compel this person to plead guilty after which the said application could be made.

      In any case, there is no harm pursuing this matter both through the criminal courts as well as through a civil summons.

  4. The lady runner is my running partner from Permaisuri. I was not with her on that fateful Sunday as I was at NB Setia Alam. She ran with another lady friend. She is still in Neuro High Dependency Ward under sedative. Dr not yet operate on her. Really hope for her full recovery. - Fang

    2. Went to see Ms Lai today. It was a very emotional visit. She could recognise some faces including mine! Her brother plan to bring her to Pantai tmr. Her mind is disoriented. Kept talking abt her work. Her speech not clear.. and couldnt sit still. Her ribs and left arm cracked.

  5. Most Malaysian drivers are simply pathetic. I've even seen riders on motorbikes texting while riding! Simply astonishing!!!

    1. Yes. I've seen it too. However more drivers uses phone than motorcyclists. THose that does that are signing their own death certificate!

  6. Really dont wanna be rude....how d**b can you be using your phone while driving? I mean seriously? if you are at a traffic light. Fine I do it also. Bu the moment I saw green light, ok thats it phone down....I dont wanna kill my self.

    Poor runner. I really hope the driver get punish hard, if the lady was my family member, I make him suffer in jail for a long time....

  8. This is dreadful. A runner's nightmare! I run along this stretch of road often and am frequently appalled by the speed at which some drivers try to take the curve. I really hope this lady recovers 100%.

    1. I run here as well and yes, I am very careful when I pass here. Since this road has became a main-road to access Publika and the Government office, traffic has been high. Not helping that the residence staying around this area speed along the road as well.

      RUn safe and we hope Lai recovers fully.
